Meal Waiver – 10-12 hours

Employees who work more than 10 hours but less than 12 hours in any day can elect to waive their rights to a second meal break of at least 30 minutes. This meal break can only be waived under the following criteria:

  • The employee can not have waived their first meal break
  • The employee and supervisor must both have agreed to the meal break waiver

The Meal Waiver – Employee Shift 10-12 Hours form must be completed and returned to the Human Resources department if an employee chooses to waive their second meal break.  The employee only needs to fill this form out once, it is not required to be completed each time the employee waives their second meal break under the 10-12 threshold. The employee’s supervisor must also agree to meal waiver and sign the form.

The employee can choose to cancel their 10-12 hour meal period waiver at any point in their employment.  Please contact the Human Resources Department if you would like to cancel your meal waiver.

The employee’s supervisor may revoke the meal waiver at their discretion.
